Terms of Service (End User License Agreement)

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User”, “you”, “your”) and yanhuali (“Developer”, “we”, “us”, “our”), the owner and operator of the mobile application Golf Master:shot tracer (the “App”), a client-side-only golf trajectory drawing and swing posture correction tool distributed on the Apple App Store (United States region).

By downloading, installing, accessing, or using our App, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable United States federal and state laws. If you do not agree to any part of these Terms, you are not authorized to use the App and must uninstall it immediately.

1. General Terms & Eligibility

1.1 The App is a pure client-side mobile application designed exclusively to provide golf swing motion recording, trajectory drawing, posture analysis, and swing correction reference functions. No server-side user data storage, cloud synchronization, or real-time network data transmission is involved in core functions.

1.2 You must be at least 13 years of age to use this App. If you are under the age of majority in your jurisdiction, you may only use the App under the supervision and consent of a parent or legal guardian, who shall be responsible for your compliance with these Terms.

1.3 All software, code, visual interfaces, features, algorithms, analysis logic, text, graphics, and other materials contained within the App are protected by United States copyright law, trademark law, and international intellectual property treaties.

1.4 You are responsible for complying with all applicable local, state, and federal laws in the United States regarding your use of the App.

2. Limited Use License

2.1 We grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App per compatible mobile device for your personal, non-commercial, recreational use only. This license is temporary and does not constitute a transfer of any title, ownership, or intellectual property rights in the App.

2.2 Under this license, you are expressly prohibited from:

2.3 This license shall terminate automatically if you violate any provision of these Terms. We reserve the right to terminate this license at any time, with or without cause or notice. Upon license termination, you must immediately cease all use of the App and permanently delete and destroy all copies of the App and related materials stored on your devices.

3. User-Generated Content

3.1 The App allows you to record golf swing videos, draw motion trajectories, generate posture analysis records, and save related files locally on your device (“User Content”). All User Content is storedlocally only on your mobile device, and we do not collect, store, upload, or access your User Content remotely.

3.2 You retain full ownership of all your User Content. You grant us a limited license to use your User Content solely to operate and render the App’s core functions on your device, with no right to reuse, distribute, or commercialize your content.

3.3 You are solely responsible for the legality, accuracy, and content of all your recorded videos and generated files. You agree not to create or store illegal, infringing, obscene, or harmful content using the App.

4. Disclaimer of Warranties

4.1 THE APP AND ALL ITS FUNCTIONS, INCLUDING BUT NOT LIMITED TO SWING TRAJECTORY DRAWING, POSTURE ANALYSIS, AND MOTION CORRECTION SUGGESTIONS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

4.2 WE HEREBY DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF FUNCTIONAL OUTPUTS.

4.3 The App’s golf motion analysis and correction suggestions are forreference only. They do not constitute professional golf coaching, medical guidance, or professional sports instruction. We do not warrant that the App’s analysis results are completely accurate, reliable, or suitable for your personal golf training needs.

4.4 We do not warrant that the App will operate uninterrupted, error-free, compatible with all devices, or free from bugs, defects, or technical failures.

5. Limitation of Liability

5.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, PERSONAL INJURY RISKS, OR ANY OTHER LOSSES ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

5.2 This limitation applies even if we have been advised of the possibility of such damages. Some U.S. jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so certain limitations herein may not apply to you.

5.3 You acknowledge that golf sports involve inherent physical risks. Any physical exercise or training guided by the App is at your own risk, and we shall not be responsible for any sports injuries or accidents incurred during your use of the App.

6. Accuracy and Modification of App Materials

6.1 The App may contain technical, typographical, or visual errors. We do not warrant that all functions, analysis rules, and content of the App are accurate, complete, or up-to-date.

6.2 We reserve the right to modify, update, optimize, or discontinue any function of the App at any time, without prior notice to users. We undertake no obligation to continuously update or maintain the App’s functions.

7. Third-Party Links and Services

7.1 The App may contain third-party links or reference third-party golf-related resources. We have not reviewed all third-party platforms and are not responsible for the content, accuracy, security, or privacy policies of any linked third-party sites or services.

7.2 The inclusion of any third-party link does not constitute our endorsement or affiliation. Your access and use of third-party services is entirely at your own risk.

8. Modifications to Terms of Service

8.1 We reserve the right to revise, update, or modify these Terms at any time without prior notice. The updated Terms will take effect immediately upon publication within the App. Your continued use of the App after the update constitutes your acceptance of the revised Terms.

9. Apple App Store Acknowledgment

9.1 This App is licensed, not sold, to you for use only on Apple-branded devices that you own or control, in accordance with Apple’s App Store terms and applicable U.S. laws.

9.2 You acknowledge that these Terms are an agreement solely between you and yanhuali, not with Apple Inc. Apple is not responsible for the App’s content, maintenance, support, or liability for any disputes arising from the use of this App.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of the United States of America and the State of Michigan, without regard to its conflict of law rules.

10.2 You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Michigan for all disputes arising out of or related to these Terms and your use of the App.

11. Miscellaneous

11.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.2 No waiver of any term herein shall be deemed a further or continuing waiver of such term or any other term.
